Condition 8202 – Study Requirement

You must remain enrolled in your registered course and maintain satisfactory academic progress. "Satisfactory" is defined by your university's own academic progression policy. Typically this means you cannot fail more than 50% of your subjects per semester.

Key risk: If you defer, cancel, or are excluded from your course, your provider must report you to the Department within 5 working days. This can trigger visa cancellation.

Condition 8501 – Health Insurance

You must maintain valid OSHC for the entire duration of your visa. If your OSHC lapses, even for one day, you are technically in breach. Set a calendar reminder 30 days before renewal.

Condition 8105 – Work Limitations

As of November 2023, the work limit increased: you can work 48 hours per fortnight during your study period. During official holiday periods (confirmed by your university), there is no limit.

What Happens If You Breach?

Your visa provider reports the breach. You receive a Notice of Intention to Consider Cancellation (NOICC). You have a right of response (usually 28 days). A migration agent can help you respond effectively. Visa cancellation is not automatic — context matters.
